Agreement to Terms

By accessing or using the Influesque website and services (the "Services"), you agree to be bound by these Terms. If you do not agree, do not use the Services.

About Influesque

Influesque is a company legally registered in the Netherlands. These Terms are a binding contract between you and Influesque, a Dutch entity.

Eligibility

You must be at least 16 years old and have the authority to enter into these Terms on behalf of your organization where applicable.

Acceptable Use

  • Do not misuse, disrupt, or attempt to gain unauthorized access to the Services.
  • Do not infringe on intellectual property rights or violate applicable laws.
  • When using any features that interact with third‑party APIs (e.g., YouTube), you must comply with the relevant platform terms and policies.
  • If you authenticate using Google OAuth on the platform, you must comply with Google’s terms and ensure that any data accessed via your account is used in compliance with applicable policies and these Terms.

YouTube API Services

Some functionality may use YouTube API Services. Your use of such functionality constitutes your agreement to the YouTube Terms of Service and theGoogle Privacy Policy. You may revoke access at any time via your Google Account permissions.

Intellectual Property

The Services, including content, trademarks, and branding, are owned by Influesque or its licensors and are protected by law. You receive no rights other than those expressly granted in these Terms.

Payment and Subscriptions

Certain features of our Services require a paid subscription. By subscribing, you agree to the following terms:

  • Payment Processing: We use Polar.sh as our payment processor. Your use of paid Services is subject to Polar's Terms of Service and Privacy Policy.
  • Billing: Subscriptions are billed in advance on a monthly or annual basis, as selected during signup. All fees are non-refundable except as required by law or as expressly stated in these Terms.
  • Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings or by contacting us.
  • Price Changes: We reserve the right to modify subscription prices. We will notify you of any price changes at least 30 days in advance. Continued use after the price change takes effect constitutes acceptance of the new pricing.
  • Payment Failure: If payment fails, we may suspend or terminate your access to paid features. You remain responsible for any outstanding fees.
  • Refunds: Subscription fees are generally non-refundable. We may, at our sole discretion, provide refunds in exceptional circumstances. Refund requests must be made within 14 days of the charge.
  • Taxes: You are responsible for any taxes, duties, or fees applicable to your subscription in your jurisdiction.

Account Deletion and Data Removal

You may request deletion of your account at any time by emailing [email protected] from the email address associated with your account. Upon receiving a valid deletion request:

  • We will delete your account and associated personal data within 30 days.
  • Some data may be retained as required by law (e.g., payment records for tax purposes) or for legitimate business purposes (e.g., aggregated analytics).
  • Data that has been shared with other users (e.g., in campaigns or lists) may remain visible to those users but will no longer be associated with your account.
  • If you have an active subscription, account deletion will cancel your subscription but will not entitle you to a refund for the current billing period.

Third‑party Services

We rely on third‑party providers for certain functionality, including:

  • Payment Processing: Polar.sh for subscription billing and payment processing. Your use of paid Services is subject to Polar's Terms of Service and Privacy Policy.
  • Authentication: Google OAuth for sign-in and account creation.
  • Content Data: YouTube API Services for creator and video data.
  • AI Features: Google Gemini API for AI-powered features.
  • Data Enrichment: Brandfetch API for sponsor/company data enrichment.
  • Infrastructure: Sentry (error monitoring), Sidekiq/Redis (background processing), PostgreSQL (data storage), Heroku (platform hosting), Vercel (marketing site hosting), and Cloudflare (DNS/CDN).

Your use of features powered by these providers may be subject to their terms. We are not responsible for the practices of these third-party services.

Service Availability

We strive to provide reliable Services but do not guarantee uninterrupted or error-free operation. The Services may be unavailable due to maintenance, technical issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with or without notice.

Data Accuracy

The Services aggregate and display data about creators, sponsors, and videos from various public sources, including YouTube and other platforms. While we strive for accuracy, we cannot guarantee that all information is complete, current, or error-free. Data may be outdated, incomplete, or contain inaccuracies. You should independently verify any information before making business decisions based on it. We are not liable for any losses or damages resulting from reliance on data provided through the Services.

Disclaimers

The Services are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee that the Services will be uninterrupted or error‑free.

Limitation of Liability

To the maximum extent permitted by law, Influesque will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Services.

Indemnity

You agree to indemnify and hold Influesque harmless from any claims or liabilities arising from your use of the Services or violation of these Terms.

Termination

We may suspend or terminate access to the Services at any time, with or without notice, for any reason, including suspected violations of these Terms. If your account is terminated for violation of these Terms:

  • Your subscription will be canceled immediately without refund.
  • You will lose access to all paid features and your account data.
  • We may delete your account and associated data.

You may also terminate your account at any time by requesting deletion as described in the "Account Deletion and Data Removal" section above.

Governing Law and Disputes

Influesque is a company legally registered in the Netherlands. These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Services will be resolved in the competent courts of the Netherlands.

If you are a consumer in the EU, you also have the right to bring proceedings in your country of residence in accordance with applicable EU consumer protection laws.

Changes to Terms

We may update these Terms from time to time. Material changes will be indicated by updating the effective date above. Continued use after changes means you accept the updated Terms.
